The Failure to Warn the Claimant

The case goes before Circuit Judge Murdock in the counter court. The trial judge said first of all that the police didn't owe a duty of care to the claimant. That's a key finding which the High Court actually overturned. In the alternative, it said there was no breach of duty. And this is also quite interesting. It said that the causation test was met. But perhaps strangely, the particulars of claim the amended particulars as it happens didn't plead that the claimant would have remained inside the property safe if she had been warned by the police about RG’s presence. They decided not to do that for whatever reason.
