Federal Judges Get to Decide the Qualifications of Their Members
The end of the judicial filibuster planted seeds that are a coming up right now in the lower courts and even among law students. Judges have become more partisan because they no longer need support from both parties to get confirmation. The incentive structure for judges has changed so much that it's not just about politics, but also their own careers.
