The Fifth Circuit's Decision to Stay Facebook's Injunction
I don't think it's unclear at all. When you're deciding how to comply with an injunction, you go by what the injunction literally says to cover your ass. And that injunction does not make a distinction between personal and private capacity. So who knows what that means. As I said at the top, it's been stayed. We're going to hear from the Fifth Circuit very soon about it. It'll be interesting to see Judge Willett is one of the judges. He is conservative, but I would hold him up as a pretty reasonable character.
