In 2004, Daniel submitted another post-conviction petition to the state of Illinois. It took years for an answer, and then in 2007, it was dismissed. That dismissal was affirmed by a state appellate court in 2010. Two lawyers from Northwestern University's Center on Wrongful Convictions had begun working on Daniel's case. They sought the court's permission to file a second federal writ of habeas corpus,. outlining all of the information that had never been shared with Daniel's attorneys during his trial.
