The Rise of the Sentencing Guidelines

Congress passed the Sentencing Reform Act of 1984. They created the Sentencing Commission. And so the sentencing guidelines they used to be mandatory but now they are merely a recommendation to judges. The Supreme Court had been running a series of cases that say basically six amendments said you have a right to a jury trial.
