This ruling does have the potential to further aroad the court's already dismal public legitimacy. The media now reports that alido's leaked draft and the fact that it was leaked, is undermining confidence in the court. What's missing is a plausible alternative that feels winnable and vicerally imaginable enough that people will fight for it. In the absence of such a violable alternative, we will continue to see the left space demobilized. I don't know if democrats dreams will come true but I certainly hope that we don't see republican sweep congress.
A timely interview from the archives: legal scholars Aziz Rana and Amna Akbar, and Movement for Black Lives lawyer Marbre Stahly-Butts, on SCOTUS, liberal court veneration, and other big questions on the law and politics facing the left.
