A lot of what gets defended as fair use is clearly not. Fair use is a gray area for one thing. It actually has to be defended in court. The only reason that you might get away with saying it's fair use is if nobody chooses to challenge you on it. So in a way you could look at that fair use argument for react content as basically just a way that large creators can turn their nose up at small creators who can't afford to defend their work. That's a pretty shitty stance.
