The authors guild case involved Google scanning the images and text of basically every book that Google could get a hold of. And it was only reproducing a very small version of that. So you weren't going to be using these tiny thumbnails for the same purpose that you were using the full res version of Perfect 10s photographs. But there is an analogy, I think there's an analogy to be made that AI is sort of doing the same thing.
