Is There a Monopoly?

I'm not convinced that they need the monopoly status. The better argument would have been, give us property rights over the wires and then we'll sell access to other companies. You just have to align the incentives such that the company that put down the wire can benefit from it no matter how long the shelf life of their product is. We opted not to do that and now we pay the price. That's really the only monopoly type things I can think of. And even this is imperfect because where I sit right now, you're going to be on one internet provider if you want anything approaching robustness and speed. They're just not nearly as good.
