Introduction
Luxury brand Hermes went to trial to protect its right to the valuable Birkin trademark against a digital artist who started selling Metabirkin NFTs. The judge specifically asked them, the jury, to determine whether or not the Metabirkins produced by Mr. Ross Shob were artistic works or consumer products. And they answered that question saying that they did not view them as artwork, they viewed them as consumer products.
