The Supreme Court has requested briefing in the independent state legislature case, more versus Harper. The court granted certiorari in a case out of the Fifth Circuit regarding the constitutionality of the CFPB. A BIP Circuit decision suggested Congress's appropriations power is so exclusive that the Fifth Circuit gets to tell Congress they can't use it.
