I think there's another component to this where maybe some of the more ideological factors come into play. And that t has to do essentially with the role of the administrative state and how much power they should have in making regulations. I saw a piece suggesting, i think it was in the washington post, but a piece suggesting that because of the more conservative make up of the court, they might rule that independent regulatory agencies are unconstitutional. Or they might resurrect the non delegation doctrine. But i'd love to hear your view on whether that's likely to happen.
