The Supreme Court - Is Section 230 Governing as Usual?
The Supreme Court normally takes no interest in statutory interpretation unless the courts of appeals disagree about the meaning of the statute. The fact that when it comes to the target recommendation theory, we have two circuits who have held that section 230 governs as usual and none that has disagreed is worrisome for those of us who hope it's properly interpreted. It really is an ominous sign that some of the justices have an itch to do mischief here.
