The Unconstitutional Role of Race in College Admissions
The constitution actually bans racial discrimination very directly. If it were the case that membership in a racial group was a reliable indicator for how people think and for their experiences i would be much more inclined to be receptive to the university's arguments. The u.s. supreme court even in its imperfect way that left open this little loophole at least finally upheld the principle that racial discrimination is wrong no matter who does it and no matter against whom it is being invoked.
