Introduction

On May 1st, the Supreme Court held that it could grant Devote's by mutual consent. This was done under Article 142 of the Constitution which gives the court power to use any means to render complete justice between parties. What does this judgment mean for Devote's heroes in India? Will it set a precedent for lower codes to do away with Amanda Trepiniud as well? Why did the codes say that this would not be a matter of right but of discretion to be exercised with care and caution? We explore these questions and more with Mihira Sood, a lawyer at the Supreme Court and a visiting professor at the National Law University, Delhi.
