The Kentucky Constitution Gives Less Protection in Free Speech

In two cases, the kentucky supreme court said there's no federal constitutional right to engage in sexual intimate conduct that is inconsistent with this or that state law. So think of it as two elevator banks. When you're in the state constitutional elevator bank, you can go up as many floors as you want and down as many floors. But when they'r in the federal elevator bank, tat they have to honor the federal right floor, wherever that is.
