The Commerce Clause: The Federal Government's Authority to Regulate Commerce
The Commerce Clause is in Article One, Section 8. It gives the federal government the authority to regulate commerce between states. So it would seem quite reasonable for Congress to declare that marijuana and hashish coming in from the Netherlands is illegal. But Congress has abused the Commerce Clause so completely that it doesn't actually mean anything anymore.
