Strict Scrutiny

00:00

The Monastery vs. Judge Motley

Motley was called a communist. She says Thurgood Marshall held her hand the entire way, which is good that she could look to him during that period. The monastery case is the most courageous decision that Motley issued over the course of her three decades on the bench. If she had not reached this decision, no one other than those who were actually in the prisoners rights movement would have been unhappy with her. And it's just a tremendous case that really does show illustrate some continuity from the sort of gladiator role that she played as a civil rights lawyer and her role on the court.
