Why Iqwa Is a Bad Law

I think that Native kids have been the tip of the spear in attacks on tribal sovereignty for generations. And so there was this really explicit relationship between taking Native kids to boarding schools and getting tribes to agree to this policy called allotment through which tribes lost two thirds of our land base. If the Supreme Court rules that Iqwa is unconstitutional because these white foster parents were discriminated against based on race, what would that look like for Native people? That's a really good question and a hard one to answer. It really depends on how they write the decision.
