The Texas Supreme Court Shuts Down a Line of Challenge to State Licenses
A Texas state court ruled in december that the delegation of enforcement to private parties violated the texas constitution. The story only pays attention to the federal courts and only talks about preinforcement review, but treats it like it is the whole kid and caboodle. There has already been a bounty lawsuit filed, at least one filed, under this law. But once they've won one with a state judge saying that the law violates federal law, or federal judge saying that it violate federal law, that will be precidential.
