Nicole: Justice Jackson's proposal as an alternative to the Barnes test, which I think is extracted directly from the text, was a textualist argument. "I got a little nervous when she talked about how she didn't think the three part test was the right test for 230," Nicole says. She adds that there's some subjectivity even when we're talking about textualism because it means different things to different people.
