The Supreme Court Should Not Declare Social Security Unconstitutional
Barrett says there are strong originalist arguments that brown was wrongly decided that social security is unconstitutional the paper money is on constitution not she's not going all the way there and saying that they are unconstitutional. Barrett: If you're only mechanism to defend against a court declaring paper money unconstitutional is you trust that no lower court is going to go there well they're going there and ultimately Barrett is either going to have to come up with another way to defend against litigants who want brown v board of education overruled or she's gonna have to take seriously arguments calling for brown vBoard of Education to be overruled.
