The Dangers of Standing in Court
The way Biden's thing was done, it's hard to make an argument that someone has skin in the game enough that they have standing in court to sue. So long as no one can find standing to sue, there's just zero that can be done about it. Everything is not a constitutional doctrine. It is simply like a judicial common law rule of thumb, presidential thing to manage work flow. And so all of a sudden, what you've done is you've taken sort of the least democratic branch of government and you've placed it at the apex of American power.
