Is Elon Musk's Intention to Take Tesla Private Really True?

The defense seems to be arguing that Musk's intention to take Tesla private was true. But it would be very, very hard to find securities fraud violations because his cards were on the table, he had aspirations, the aspirations didn't work out. I think there really will be this odd fight about just how far away this case was from the no liability at all hypothetical versus the sort of a diabolical, full-blown, detailed, untruth.
