The Importance of Retaining Rights
The Ninth Amendment is often called the stepchild of the Constitution because it's so often been ignored by the federal courts. It says other rights retained by the people are protected as a routine right, and then we can argue about well, where is that line and where's the government's legitimate interest in in regulating some of these rights? The fact that the right is there and that it is specifically protected by the Constitution through this open ended language is not that hard to fathom.
