The President's Defense Team's Political Argument in the Senate's Brief Before Trial

One of the interesting issues that we may see unfold in terms of the President's defense team is how they handle the President's claims about election fraud. That's a highly controversial area that Republicans in the Senate do not want to see as a centerpiece of that defense. Another constitutional argument the defense is going to use is that Trump had the First Amendment right to make the speech that he did. But I think it's probably not going to be a particularly persuasive argument for those people who are going to watch this trial unfold on television.
