The Disconnection of Justice Jackson's Dissenting Opinion
I think that when you get someone like Justice Jackson in dissent, she starts to get into probably, you know, I'm never trying to read her mind too much. She just kind of waves her hand at this concern and suggests that this isn't a problem at the North Carolina policy. There's just something that's obviously very arbitrary about this and highly selective. This is a matter of special concern for particular people, which necessarily is happening at the expense of other people. For the most part, I see a great deal of moaning and also a lot of rather frustrating, soft bigotry of low expectations.
