Smart contracts are not legally binding, but at some level they are. Under english law, there are a number of requirements for what constitutes a illegally binding agreement. The only thing that we could use was a fatalistic execution paradon to prevent forced majure events from recurring. If the intention was not, from the outset, to create something that would withstand a lenge in litigation, then they had to look at, well, without the back hup of the law, what can we use?
