The Court's View on Non-Delegation

The courts have a view that maybe the executive branch is the best place for those issues to be worked out. My view personally is that stretching is not good overall for representative government. Maybe I guess the courts could nudge the political energy back to Congress, but that's going to require a huge judgment call by the Supreme Court itself.
