The Death Penalty and Debauched Executions
The Supreme Court has in the past, although it's been many years ago, did refer to practices in other countries. I think that the framers of the Constitution at the time that the 8th Amendment was ratified would be shocked to think that since we had just fought a revolution against another nation so that we could establish our own mores. The reason why the death penalty was abolished in those countries is not because each country took a vote. That decision was made in Brussels.
