"I guess we need to say what weak discretion is," Dworkin writes. "We already have standards like it is a strike if it is within ... It's just a matter of who's going to measure that." In the second sense, an official can't be appealed to higher in the hierarchy than they are. The more relevant sense of weak discretion is just judgment, he says.
