Is D a Contract, or a No?

If D had been no, because there was no meeting of the minds, would we still have the same problem or no? That would be interesting if that were deep. Sometimes the bar will make you guess will have you say like, I want you to weigh in it's 70 30. But sometimes they will reward you for knowing that this is 70 30 as opposed to a yes or a no. The fact that there was late that was also coercion is not the crucial fact here upon which the fact pattern turns.
