The Evolution of the Commerce Clause

The Commerce Clause was originally written in reference to tariffs and trade. It's more or less left at that probably in large part because when everybody started thinking about what that really meant across the national level it would eventually get into slavery. The courts were swatting down FDR legislation all over the place oh yes he was he had like minimum wage  and they're like yeah you can totally do that on a state level you can'tDo that on a federal level there's nowhere in the Constitution that's that would violate the 10th amendment.
