In 2013, the court gave a carve out from statute and regulations requiring health insurance that covers contraception to religiously motivated business owners. That was in the context of employment rather than public accommodations. This case would be the first time they're addressing it in this specific context. But I do think Justice Sotomayor is right, harkening back to those cases from the 1960s and the 70s with respect to race.
