The Court Hasn't Goed to Non-Delegation Route, at Least Not Yet
The court has not gone to non-delegation route, at least not yet. We have major questions. So is the fact that the court has created or employed major questions a problem for your approach being put into practice? I think so in that the major questions doctrine is, at least of mine, are saying it's a statutory doctrine. And over that time, we haven't been developing the non-delegate principle.
