There seems to be a lot of confusion around two specific scenarios. As long as you're not touching the phone, your phone can be loose in your car. The misunderstanding came from the fact that the motor vehicle act does allow you to use your phone when you're lawfully parked. But there was a case on this where somebody put it in park to use their Starbucks app. They were found guilty and lost their appeal as well.
