Juries make value judgments all the time. The rule of law requires consistency, so consistent acts that happen are either crimes or they are not,. And that's why the main criticism here is the fact that it looks like a perverse verdict on the potential that it was based on. But i like to think of the constitution as like living in a big, old victorian house. There are rooms in this house we haven't visited for a very long time.
