The Supreme Court's Opinion on the Bill of Rights
The bill of rights didn't apply to laws that were passed by the states. They only applied to laws passed by the federal government. The early days of our nation were marked by a pretty firm division between state and federal power. So there was a lingering question of how you enforce federal constitutional rights against states.
