Do You Think There's a Surplus of Special Counsels?
Under the independent council statute, there was a preliminary investigation done by the Department of Justice. But the appointment was mandatory for people who were in high-level executive branch positions. The regulations say that the attorney general will appoint a special council if three conditions pertain: criminal investigation is warranted, there's a conflict of interest or other extraordinary circumstances.
