The Senate and the Courts' Reaction to the Senate's Rulemaking
The problem is clear enough. You have a rule that is issued by a high level appointee of the president who has not been Senate confirmed. Those rules are null and void as far as you or I would be concerned. Congress can fix it literally with one sentence if it wanted to, and I think it should.
