Activity-Based or Entity-Based Financial Regulation?
The current framework for financial regulation outside the banking sector follows an activity-based approach. This is where providers must hold licenses for the specific business lines that they are in. And then you have entity-based rules on the other hand and they consist of requirements imposed on institutions that have a specific license. The idea here is actually that if you apply activity-based licensing requirements consistently this should minimize the scope for regulatory arbitrage.
