The Problem With Administrative Subpoenas
Some records collections are so puzzling because there's almost no way they could have any relation to the type of authority that immigration and customs enforcement has. Is this the kind of thing where people would feel better about it if ICE had to make their case in front of a judge? Absolutely. And without having that extra gate, that extra check on executive power, we are leaving this collection to the whims of executive agencies. It goes against the system of checks and balances that's inherent in our Constitution.
