The Ethics of AI

When you're giving power to machines, who should be in charge of determining what these machines can and cannot do? I don't know if this goes outside of ethics, but I'm curious about like liability. So if I use an AI tool to help out with content and it plagiarizes something that was trademarked or copy written copyright and excuse me. Is that the right copy righted.?
