How Does Effective Legal Writing Stand Out?
David French: Legal writing is dispositive most of the time. He says it's important to present arguments in a clear and straightforward way. Judges are using footnotes plenty, but he wouldn't use them as a general rule. David French: The one thing we've seen about parentheticals is that they're actually changing the law.
