The 14th Amendment and the Debt Ceiling
The president can simply authorize the issuance of new and additional debt because it is his duty, as Lawrence Tribe points out brilliantly. There is nowhere, anywhere, even the hint or suggestion that there is an executive authority to decide what bills not to pay. And so I would say if you were going to use the 14th Amendment power, the power that people believe resides there, I would have announced it a while ago.
