Is There a Continued Threat or Imminent Threat?
The term "imminence" is often used to describe an imminent threat. But it can also mean that there's a fleeting window of opportunity where you could strike the person again, says Peter Bergen. The Obama administration tried to use international human rights law as its model for non-combat zone strikes in Iraq and Syria. That may be hard to establish with respect to whether or not you're allowed to use force when the target isn't on the verge of attacking someone.
