The Gap Between Tribal and Federal Law in the United States
Tribal law and sovereignty treaties, et cetera, essentially it prohibits or precludes native americans from bringing white people to justice if something happens on reservation land. So a tribe has authority to prosecute tribal members when they commit a crime against other indians. But when there's a crime against a a non indian, against an indian, then the tribe is denied the ability to prosecute that crime. And for the most part, that alls within the federal jurisdiction. If it is a misdemeanor crime, the federal government prioritizes felonies. There's this whole level of crimes that end up getting just dropped. Fall fall into the gaps, and there's no action...
