The Importance of Proxies in Higher Education
There's a statistical point, which is, you know, if you go to the proxy, put more weight on essays than less on test scores or use geographic designations. Does it statistically have the effect of advancing the proportion of the class that's black? So that's one question. Another question is, was that the intent that they do it in order to have that effect? And you have to kind of discriminate between those two things. I mean, just because it had the effect of enhancing black presence in the class doesn't on that alone make it unconstitutional.
