The framers started to up in the early 18 hundreds when there were repeated bitter constitutional disputes over how to apply the different clauses of the constitution. The frequency of this phrase reached a peak in the 18 thirties, probably because of the fire storm around the tariff. It can sound as if these founders were simply trying to create a framework or a set of limits within which entities could then operate as they choose. And it also can create the sense furthermore, of a sort of value neutral government. But there are a lot of problems that come up with this concept.
