Mr Justice Moston said that an expert has a duty to disclose actual or potential conflicts. There is still no explicit reference to this either in the rules or the practice directions, which is a curiosity because one would have thought that conflict of interest is pretty crucial with regard to experts. He went on to look at what examples might be of that and one, for example, was if firms of solicitors do entertain experts as part of marketing. And I flag that up because I think everyone has got much more conscious of the need to be entirely open and proper. These things now need to be drawn to attention and the other side's attention.
